Terms of Use and Sale

These Terms of Use and Sale govern your use of our website at www.FrigidaireOutdoorLiving.com and any other websites to which we link these Terms (our “Website”), our product registration pages and forms, our customer support pages, and any related communications or services we provide in connection with product registration, warranty administration, and product support for Frigidaire branded BBQ grills (collectively, the “Services”). The Services are provided by Turpone Product Licensing Inc. (the “Company,” “we,” “us,” or “our”).
Frigidaire® is a pending or registered trademark of Electrolux Home Products Inc. and used under a license from Electrolux Home Products Inc.
The Company is an authorized licensee of the Frigidaire brand. The Company is not Electrolux Canada Corp. or the brand owner. Any references to Frigidaire relate to the branded products for which the Company provides registration and support services. Where permitted by applicable law, and excluding individual residents of Quebec, note that Section 20 of these Terms contains an arbitration clause and a class action waiver provision. It affects how disputes between you and the Company may be resolved.
1. Acceptance of these Terms
By accessing or using the Website or any of the Services, you agree to these Terms of Use and Sale (the “Terms”) and to our privacy policy (the “Privacy Policy”). If you do not agree to these Terms or the Privacy Policy, please do not access or use the Website or the Services.
2. Modifications and Termination
We reserve the right to modify the Services at any time, with or without notice to you. For example, we may add or remove functionality or features, and we may suspend or stop a particular feature altogether. Any revised versions of the Services will be subject to these Terms, unless we provide otherwise. If you do not agree to any changes, you may stop using the Services at any time.
3. Your Account
You may be required to create an account or provide certain information in order to use certain Services, including product registration. To create an account, you must be at least 18 years old and you must provide truthful and accurate information. Do not impersonate anyone else when you create your account. If your information changes at any time, please update your account to reflect those changes.
You may not share your account credentials with anyone else. You are solely responsible for the activity that occurs on your account and for keeping your credentials secure. We are not responsible for your failure to comply with this clause, or for any delay in restricting access after you have reported a security issue.
4. Your Use of the Services
You may not use the Services in a way that violates any laws, infringes anyone’s rights, is offensive, or interferes with the Services or any features of the Services (including any technological measures we employ to enforce these Terms). If we determine that you have acted inappropriately, we reserve the right to remove content, restrict access, terminate accounts, prohibit you from using the Services, and take other legal actions we deem appropriate.
Using the Services does not give you ownership of any intellectual property rights to the content you access. You may not use content from the Services unless you obtain permission from us or its owner, or unless you are otherwise permitted by law.
5. Prices and Payment
If the Services include any purchases offered directly by the Company (for example, replacement parts, accessories, shipping services, or other goods or services that may be offered through the Website from time to time), you have a legal obligation to pay for any orders made by you or through your account.
To complete an order, you may be required to provide additional information necessary to process the order, including valid payment information. By completing an order, you agree to pay in full the listed prices and all applicable taxes and specified shipping and handling and other fees in relation to your order.
Payments may be processed by a third-party service provider. We may change permitted methods of payment at any time.
If complete payment is not received and verified by us, your order may not be processed.
6. Orders
All orders made through the Services are subject to these Terms, as well as any other applicable terms and conditions outlined on the Website relating to the order.
Adding items to a cart does not reserve them or guarantee availability. Items may sell out before checkout is completed.
We use reasonable efforts to fulfill orders, but cannot guarantee availability of any particular product or service. We reserve the right to limit quantities, refuse service, cancel orders, and correct pricing errors. If payment has already been made for an order that is cancelled due to an error or unavailability, we will refund the amount paid in accordance with our refund process.
We reserve the right to verify orders and may require proof of identity or other information to validate an order.
7. Shipping and Delivery
We may restrict delivery to addresses within Canada. If we are not able to ship to the shipping address you provide, we will notify you, cancel the order, and issue a refund unless an alternate eligible address is provided.
Estimated delivery timelines are provided as estimates only. Delivery delays may occur and may be outside of our control, including when shipments are handled by third parties. Multiple items may ship separately.
8. Returns and Cancellations
Returns, exchanges, and cancellations are subject to the return policy posted on the Website at the time of purchase or otherwise communicated to you in writing. Products must be returned in the condition required by the return policy.
Certain items may be non-returnable, including items marked final sale, customized items, or items that cannot be resold for health or safety reasons.
9. Read the Manual
The Services are not a substitute for responsible and safe product operation. Please refer to your owner’s manual and safety instructions. You should not rely on the Services as a means of preventing accidents, fire, or damage to your product or residence. It is your responsibility to ensure your product is used and maintained safely and in accordance with applicable instructions.
10. Product Registration and Warranty Administration
Product registration is intended to help us administer warranty support, customer service, and product safety communications. Registration does not replace the requirement to retain proof of purchase for warranty claims. Warranty coverage, if applicable, remains subject to the terms and conditions of the applicable written warranty documents provided with the product or otherwise made available to you.
You represent that the information you submit during registration is accurate, including model and serial information. We may request proof of purchase, additional product details, photos, or other information when evaluating warranty or support requests.
11. Trademarks and Copyrights
All trademarks, logos, and service marks displayed on the Services are owned by the Company or third parties who have authorized their use (collectively, the “Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks except as permitted by law or with written permission.
Frigidaire is a registered trademark used under license. Electrolux and Frigidaire related marks may be owned by their respective owners.
All materials on the Services are protected by copyright unless explicitly noted otherwise.
12. Content You Post
We may provide opportunities for you to post text, photographs, videos, or other content (“Content”) on the Services. You may only post Content if you own all necessary rights or have permission from the rights holders.
By posting Content, you grant the Company, its agents, licensees, and assigns a non-exclusive right to use, reproduce, store, display, and distribute your Content in connection with the Services. This license continues even if you stop using the Services to the extent necessary to operate the Services and maintain records.
You agree to indemnify the Company against liability, claims, actions, loss, damage, cost, or expense arising out of Content you post, to the extent permitted by applicable law.
13. Code of Conduct
You agree you will not use the Services to submit Content that is unlawful, defamatory, obscene, infringing, harmful, or otherwise inappropriate, or that contains malicious code. We reserve the right to remove Content or restrict access at any time, in our sole discretion, where permitted by law.
14. Content Posted by Others
We are not responsible for, and do not endorse, Content posted by other users. We may not be held liable for any loss or damage arising from Content posted by others.
15. Non-Confidential Information
Subject to our Privacy Policy, any material, information, or idea you transmit through the Services may be treated as non-confidential and non-proprietary.
16. Copyright Protection
If you believe Content on the Services infringes your copyright or other proprietary rights, you may request removal by contacting us and providing:

- Identification of the allegedly infringing material and its location

- A statement of good faith belief
- A statement that the information is accurate and you are authorized to act

The Services may include features that operate in conjunction with third-party social networking websites (“Social Network Features”). Your use of Social Network Features is also governed by the terms and policies of the applicable third parties.
18. Our Warranties and Disclaimers
We provide the Services using a commercially reasonable level of care, but there are certain things we cannot guarantee.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT WHERE PROHIBITED FOR INDIVIDUALS RESIDING IN THE PROVINCE OF QUEBEC, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS, SO THE ABOVE MAY NOT APPLY TO YOU.
THIS SECTION DOES NOT LIMIT ANY WRITTEN WARRANTY PROVIDED WITH A PRODUCT, WHICH REMAINS SUBJECT TO ITS OWN TERMS AND CONDITIONS.
19. Liability for our Services
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND WITHOUT LIMITATION TO ANY RIGHTS THAT CANNOT BE EXCLUDED UNDER QUEBEC LAW WHERE APPLICABLE, WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
20. Disputes
This Section 20 applies to the maximum extent permitted by applicable law, and does not apply to individuals resident in Quebec.
You and the Company agree that any dispute or claim arising out of or relating to your use of the Services or these Terms shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration shall be administered by the ADR Institute of Canada under its applicable rules. Arbitration shall be conducted by a single neutral arbitrator.
We each agree that dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial where permitted.
Nothing in this section prevents either party from seeking injunctive relief for misuse of intellectual property rights.
21. Changes to these Terms
We may modify these Terms at any time and from time to time. We will post updated Terms on the Website or provide notice through other communications where required by law. Continued use of the Services after the updated Terms are posted means you agree to the updated Terms. If you do not agree, you must stop using the Services.
22. Additional Details
The Services may contain links to third-party websites or applications. We do not control or endorse those third parties and are not responsible for their content, policies, or practices.
When you use the Services or send communications to us, you are communicating with us electronically. You consent to receive communications related to your use of the Services electronically. You agree that electronic communications satisfy legal requirements that such communications be in writing.
For users that are not individuals resident in Quebec, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules, and the courts located in Toronto, Ontario have jurisdiction.
For individuals resident in Quebec, these Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of laws rules, and the courts located in Montréal, Quebec have jurisdiction.
If a particular provision in these Terms is not enforceable, that will not affect any other provision.
